Terms of Service

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account. You agree to:

• provide accurate account information;
• keep your credentials secure;
• notify us promptly at support@nanflo.co if you believe your account has been compromised; and
• use the Service only through your own account unless we expressly authorize otherwise.

Authentication is currently handled through Auth0 or other providers we may support from time to time.

NanFlo provides tools that may allow you to:

• connect financial accounts through Plaid;
• map linked accounts to card templates;
• view transactions, balances, rewards, and related wallet information;
• request card recommendations based on merchants, categories, or spending context;
• view insights, perks, and reminders; and
• use nearby or widget-based recommendation features when available.

The Service is for informational, organizational, and educational purposes only.

NanFlo is not a bank, card issuer, broker-dealer, lender, credit repair organization, tax adviser, accountant, or law firm. NanFlo does not provide financial, tax, investment, accounting, or legal advice. Recommendations, valuations, and insights are estimates and may be incomplete, delayed, or inaccurate.

You should independently verify important financial information with your bank, card issuer, or financial institution.

NanFlo is in active development. Features may change, be added, be removed, or stop working. Some integrations may depend on sandbox or third-party environments. We may update, suspend, or discontinue features at any time. We are not obligated to continue any specific feature, workflow, or integration.

The Service relies on third-party services including Plaid, Auth0, Apple, and Sentry. Your use of those services may be subject to their own terms and policies. NanFlo is not responsible for the availability, content, accuracy, practices, or security of third-party services.

To operate the Service, you grant NanFlo a limited, non-exclusive, revocable right to:

• access and process the account and transaction data you authorize through Plaid or other supported providers;
• process the text, screenshots, images, and other content you submit in order to provide the requested feature;
• store your preferences, wallet configuration, and related app data; and
• use on-device shared storage required for widgets, app extensions, and nearby recommendation surfaces.

You represent that you have the necessary rights to provide any content or account access you authorize.

You agree not to:

• use the Service for unlawful, fraudulent, deceptive, or abusive purposes;
• interfere with the Service or attempt to gain unauthorized access to systems, accounts, or data;
• reverse engineer, decompile, disassemble, or attempt to extract source code except as allowed by law;
• use automated tools to scrape, crawl, or abuse the Service without our prior written permission;
• submit malicious code, harmful content, or misleading information; or
• use the Service in a way that infringes another person's rights.

Some features depend on device permissions such as location, notifications, camera or photo access, or biometrics. You control these permissions through your device settings. If you disable required permissions, some features may not work.

NanFlo does not receive or store your biometric templates. Apple manages Face ID and Touch ID on your device.

Some versions of the Service may show "Apply Now" or similar links for card products. If you use one of these links:

• you may be sent to an external issuer or partner site;
• the external site is governed by its own terms and privacy policy; and
• NanFlo may receive referral compensation from the issuer or partner if you apply or are approved.

Any compensation is paid by the partner, not by you. NanFlo does not guarantee approval, card terms, rewards, or the availability of any offer.

Unless we explicitly tell you otherwise, the Service is currently offered without a subscription fee during this stage of release. We may introduce paid features or subscriptions later. If we do, we will provide notice before charging you.

You may stop using the Service at any time. You may also use the privacy and account controls in the Service to request deletion of your data or your account.

We may suspend or terminate your access to the Service if:

• you violate these Terms;
• we reasonably believe your use creates risk for NanFlo, other users, or third parties; or
• suspension or termination is required by law, regulation, or a third-party provider.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, dispute provisions, and any payment obligations.

The Service, including software, visual design, text, graphics, models, data structures, and other content created by or for NanFlo, is owned by NanFlo or its licensors and is protected by law. Except for the limited rights expressly granted to you in these Terms, NanFlo retains all rights, title, and interest in and to the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANFLO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE ACCURATE, COMPLETE, SECURE, OR UNINTERRUPTED.

WE DO NOT WARRANT THAT RECOMMENDATIONS, REWARDS ESTIMATES, INSIGHTS, OR OTHER OUTPUTS WILL BE CORRECT OR SUITABLE FOR YOUR PARTICULAR SITUATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANFLO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANFLO'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID NANFLO FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to indemnify, defend, and hold harmless NanFlo and its affiliates, officers, employees, contractors, and agents from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:

• your use of the Service;
• your violation of these Terms;
• your violation of any law or third-party right; or
• any content, account access, or information you submit, authorize, or make available through the Service.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.

To the extent a dispute is permitted to be brought in court, you and NanFlo agree to the exclusive jurisdiction and venue of the state or federal courts located in Delaware, except where applicable law does not permit that forum-selection clause.

If you download the iOS app through the Apple App Store, the following additional terms apply:

• these Terms are between you and NanFlo, not Apple;
• Apple is not responsible for the Service or its content;
• Apple has no obligation to provide maintenance or support for the Service;
• if the Service fails to conform to an applicable warranty, you may notify Apple, and Apple may refund any purchase price you paid for the app, if applicable; and
• Apple and its subsidiaries are third-party beneficiaries of the applicable provisions of these Terms.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide additional notice where appropriate. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.
